
News Topical, Digital Desk : The Calcutta High Court has said that finding another job with better facilities is a fundamental right of a person and even if he joins a rival company, it cannot be considered moral turpitude.
The court said that non-payment of dues to an employee on this ground by a company is against the principles of justice. Cancelling the disciplinary order and penalty of an insulator film manufacturing company, Justice Shampa Dutt Pal of the High Court directed to pay the gratuity amount of Rs 1.37 lakh along with simple interest at the rate of eight per cent per annum to the employee.

Justice Dutt said that the petitioner company could neither produce any witness nor show any call record to substantiate its allegation that the respondent was in touch with a rival company.
The court reprimanded the company
The court said that the petitioner company could not even prove that it suffered any loss. This petition was filed in the court against the orders passed by the appellate authority, which directed to pay the gratuity dues to Sudip Samant, who was working as a technician in the company. Based on the report of the investigating officer, the technician who joined the company in 2012 was dismissed from service on October 11, 2022.
