Nainital. Nainital High Court: The High Court approved the divorce of the newly married couple, cancelling a decision of the family court of Haridwar. The couple had separated within 25 days of marriage.

The court said that there is no emotional bond between the husband and wife. In such a situation, this marriage is nothing more than a lifeless union. If divorce is not granted to both the parties, it would be cruelty to both the parties. The court ordered the husband to pay Rs 25 lakh as permanent alimony as per the divorce agreement.

The Haridwar man and Kanpur woman (both in their 20s) got married on May 2, 2019. The two separated on May 27. After attempts to resolve the matter through mediation failed, the woman filed an FIR under the Dowry Prohibition Act.

Dissatisfied with the decision, the husband challenged it in the High Court

In 2021, the Haridwar family court directed the husband to pay monthly maintenance of Rs 20,000 to his wife, but did not give a divorce decree. Dissatisfied with the decision, the husband challenged it in the High Court.

After examining the case, a division bench of Chief Justice Ritu Bahri and Justice Rakesh Thapliyal concluded that since both the parties are eligible, it would be cruel if they are not freed from this relationship. There is also no scope for reconciliation between them.

The court directed the husband to pay the alimony amount within six weeks and inform the court about the payment by September 26.
