News Topical, Digital Desk : The Calcutta High Court has given an important decision stating that even if the woman is employed in some form of employment, such as a job, the unemployed former husband who abandons her cannot escape the responsibility of bearing the expenses of her maintenance.

A bench headed by Justice Ajay Kumar Mukhopadhyay issued the ruling in a case where the woman works for a monthly salary of ₹12,000, while her ex-husband is unemployed. The family court had ruled in her former husband's favor, considering his financial situation.

The woman approached the High Court

The woman appealed this decision to the High Court. The judge stated that the former husband has a social, moral, and legal obligation to provide for the woman's upkeep after a divorce. This cannot be avoided. If an able-bodied man remains unemployed, it is a voluntary decision.

The marriage took place in 2012

This cannot be used as a shield to avoid legal obligations. The judge advised the former husband to find a job. The two had legally married in 2012. The woman's in-laws did not accept her because it was not a social marriage. Later, the husband filed a divorce case in the family court. The woman demanded a monthly maintenance payment of 10,000 rupees, which the husband claimed was unemployed.
