What did the Kerala High Court say?
Let us tell you that on 12 September 2024, both the petitions filed in the Kerala High Court were heard. After the hearing, the court said in its decision that it is not right to prevent the installation of plastic film or cooling film on the windows of vehicles as per the rules. If the police is challaning for cooling film or plastic installed on the window glass, then it is wrong. The court said that if the film is installed on the glass of the car under the rules of the Central Motor Vehicle Act, 1989, then it would be wrong to challan. Car drivers can get plastic film installed on the windows as per their need. However, a fine will still be imposed on completely black glass or film with zero transparency. This decision of the Kerala High Court will give great relief to car drivers.
What are the rules?
In fact, in the year 2012, the Supreme Court had completely banned black film. The court had said that black film on vehicles poses a threat to public safety. However, as per the amendment to Section 100 of the Central Motor Vehicle Rules, effective from April 1, 2021, the use of 'safety glazing' instead of safety glass on the front, rear and sides of motor vehicles has been allowed. According to the amended rules, 70 percent transparency is required on the front and rear glass and 50 percent on the sides. Referring to this amendment, the court clarified that the use of such films is legal. However, if black glasses with zero visibility are installed in the car, a fine of Rs 500 can be imposed for this. If the driver repeatedly breaks the rules, his license can be suspended and the vehicle can be seized.
