This first FIR was registered in the Delhi Cantt police station area. Now, following the registration of this first case, many more cases of action against wrong-side driving may emerge. What is the whole matter?
This case involves speeding and driving a four-wheeler in the wrong direction. The accused has been identified as Aman, a resident of Shahjahanpur (UP), currently residing at Kusumpur Pahadi, Delhi. The incident occurred at 4:45 p.m. near the Hanuman Mandir red light. Driving on the wrong side posed a threat to oncoming vehicles. An FIR was registered based on the complaint of ASI Sunil Kumar.
What is the provision for punishment?
In this case, an FIR has been registered against the accused under Section 281 of the IPC. Section 281 (rash/negligent driving causing hurt by dangerous weapons or explosive devices) carries a punishment of up to six months in prison, a fine of up to 1,000 rupees, or both. Previously known as Section 279 of the IPC, the accused did not have a driver's license or vehicle insurance. Therefore, he has also been charged under sections 3, 181, 146, and 196 of the Motor Vehicles Act.
Now there will be a direct FIR in serious cases
Since these sections in this case of driving on the wrong side were bailable, the accused was granted bail from the police station itself. Earlier, only a challan was issued in such cases. However, now in serious cases, a direct FIR will be registered. However, let us tell you that FIR will be registered only in case of serious danger. Strictness has been imposed on wrong side driving especially during the morning and evening peak hours. Generally, there will be no FIR for slow speed two-wheeler on a small road but a heavy fine will be imposed.
