The court upheld the May 3, 2025, order issued by the Municipal Court. This means that the disputed structure will be completely demolished, from the ground floor to the top floor. The court clearly stated that the construction is illegal and must be completely removed.
Waqf Board, Sanjauli Mosque Committee had appealed
The decision came on appeals filed by the Waqf Board and the Sanjauli Mosque Committee, which were dismissed by the district court. Both parties had challenged the Municipal Court's order, but the district court upheld the Municipal Court's decision. Jagat Pal, lawyer for the Devbhoomi Sangharsh Samiti, stated that both appeals filed against the Municipal Court's decision were heard in Yajuvinder Singh's court, and both were dismissed within six months. Jagat Pal stated that the disputed structure will now be completely demolished, as the entire building was constructed illegally.
This is the fourth verdict in the Sanjauli Mosque dispute case.
Jagat Pal explained that this is the fourth decision related to this case. The first decision came on October 5, 2024, ordering the demolition of the third, fourth, and fifth floors. However, the Municipal Corporation had not taken action until then. The Waqf Board challenged this decision in the district court, but within a month, Praveen Garg dismissed the petition. Subsequently, on May 3, 2025, the Municipal Court declared the entire structure illegal and ordered its demolition. Now, the District Court has upheld the same decision.
Devbhoomi Sangharsh Samiti welcomed the decision.
Vijay Sharma, co-convener of the Devbhoomi Sangharsh Samiti, welcomed the court's decision, calling it a victory for the Sanatan community. He said, "We congratulate the Sanatan community across the state. On September 11, 2024, when we held a peaceful protest, we were lathi-charged and water cannons were used. Today's decision makes that struggle meaningful. Now the Municipal Corporation should demolish the disputed structure without further delay."
The mosque committee will move the High Court against the decision.
Meanwhile, Mohammad Latif, president of the Sanjauli Mosque Committee, said that further action will be decided after reading the court order. He said, "We will appeal this decision in the High Court." Madan Thakur, another co-convener of the Devbhoomi Sangharsh Samiti, said that the government should now apologize to those affected and withdraw all cases filed against them during the peaceful protest. He said that the committee will not back down until the Waqf Board is abolished in Himachal Pradesh.
