News Topical, Digital Desk : National Herald Case: The much talked about National Herald case was heard in Delhi's Rouse Avenue Court on Wednesday. This hearing was held in the court of special CBI/ED judge Vishal Gogne, in which former Congress President Sonia Gandhi, MP Rahul Gandhi and others have been made accused. During the hearing, ED said that people were paying fake advance rent for years. The rent receipts were fake. Advertising money was given to AJL on the instructions of senior Congress leaders. ED said that any income earned from such fraud is 'proceeds of crime'.

The ED said that some donors who are well-known big names and senior leaders of the party have paid some amount as rent, so if it will be considered as proceeds of crime, why will they not be made accused? One of the accused Suman Dubey transferred shares to Sonia Gandhi. Oscar Fernandez transferred shares to Rahul Gandhi and Rahul sent it back to Oscar Fernandez. These are all fake transactions. These exist only on paper. The ED said that till 2015, there are only two beneficiaries and that is Rahul and Sonia Gandhi. A beneficiary is one who has control over the company.

The court asked the ED, "Are rent, advertising money etc. also considered as proceeds of crime?" ASG SV Raju, appearing for the ED, said, "Yes, any property acquired through fraud will come under POC."

Court's question regarding POC 

The court said, "These three categories are not clearly shown as POC. They are just presented as some points. The rent is also in two categories - 29 crores and 142 crores. While 142 crores is called POC, 29 crores is not called so.

Court- He was not made an accused? 

The court said, "We are asking this because some of the donors about whom you are saying that they made fake donations are also members of the same party and some are even prominent faces. But they have not been made accused. If advance rent and donations are considered POC, then will those persons not come in the category of respondents.

ED's reply to the court's question

To this, ED replied, "We are investigating the issue whether a property comes under POC when it is acquired or before that." The court said, "Our purpose is only to understand what things ED is considering as POC and what not." ED said, "At the present stage, we consider these things as POC. We can investigate further and it will be included in the supplementary chargesheet." ED said that we will also file a supplementary chargesheet in this case further.
