News Topical, Digital Desk : Supreme Court Justice Ujjwal Bhuyan on Saturday, January 24, questioned the government regarding the independence of the judiciary. Ujjwal Bhuyan said, "The biggest threat to the independence of the judiciary lies within the system itself."

Justice Ujjwal Bhuyan expressed his disagreement and disappointment over the collegium's decision to transfer Justice Atul Sreedharan from the MP High Court to the Allahabad High Court on the suggestion of the Centre.

Justice Bhuyan made this remark at the Principal G.V. Pandit Memorial Conference on Constitutional Ethics and Democratic Governance at ILS Law College, Pune. "This shows a significant interference of executive influence in the collegium system, which is unfortunate," Justice Bhuyan said.

Supreme Court Justice raised questions

Without naming Justice Sreedharan, Justice Bhuyan asked why a judge should be transferred from one High Court to another just because he had passed some inconvenient orders against the government.

The Supreme Court Collegium had recommended the transfer of Justice Sridharan from Madhya Pradesh to Chhattisgarh High Court in August 2025, but on the appeal of the Centre, the Collegium changed its decision.

Was the action against the BJP minister punished?

The collegium transferred Justice Sreedharan to the Allahabad High Court in October, a move many legal experts described as punitive for passing orders inconvenient to the government.

The bench headed by Justice Sridharan had itself taken cognizance in May 2025 against BJP minister Vijay Shah for using derogatory language against Colonel Sophia Qureshi.
