News Topical, Digital Desk : If someone arrested by the police is under 18 years of age, no matter how serious the charges against them, they are entitled to anticipatory bail. This ruling was recently issued by the Kolkata High Court.
While delivering this verdict on Friday, a bench of 3 judges in the Kolkata High Court said that till now only adults were able to get anticipatory bail, but now this rule will be applicable to minors also.
What did the Kolkata High Court say?
A three-judge bench of the Kolkata High Court, comprising Justices Jay Sengupta, Tirthankar Ghosh, and Bivas Patnaik, delivered this ruling. They stated that even minors involved in any crime can file for anticipatory bail. With this, the Kolkata High Court became the first court in the country to issue such a ruling.
What was the rule till now?
Legal experts believe this decision is commendable. Until now, juvenile offenders were presented before the Juvenile Justice Board, which determined whether the accused would be granted bail. However, the board did not have the authority to grant anticipatory bail to those accused of serious crimes.
2 judges agreed
Two of the three judges in the Kolkata High Court supported this decision. Justices Sengupta and Ghosh said that granting anticipatory bail to minors is appropriate, but Justice Patnaik opposed it. Consequently, the decision was passed 2-1. Now, any minor offender can apply for anticipatory bail.
