US Border Patrol Chief Michael Banks said on X that the fines will apply to all illegal entrants, regardless of where they entered, how long they have been in the US, or whether they have an ongoing immigration case. The fines will be imposed at the time of arrest, not after a court decision.

This policy is based on 8 USC 1815. Under this law, anyone entering the United States without permission must pay this fee upon arrest. In some cases, additional penalties may also be imposed under 8 USC 2339 and 1324.
Who will pay this fine?
- Those who are 14 years of age or older.

- Those deemed inadmissible under immigration law.
The policy applies throughout the United States, not just at the border. It also does not matter when a person arrived, how long they have been living, or whether their immigration case is still ongoing.
What happens if I don't pay?
If a person fails to pay the $5,000, the amount will become a debt to the U.S. government. Such a person may be barred from legally entering the U.S. or receiving any immigration benefits in the future. DHS says the fine will remain on the record until it is paid.
Arrest in America and the impact of the law
However, the US border arrest rate is now at its lowest in decades. According to DHS , approximately 7,300 people were apprehended at the Mexican border in November, slightly fewer than in October. To address this decline, US agents are now conducting operations in major cities within the country. In Los Angeles and Chicago, arrests have been made at car washes, Home Depot parking lots, and other public places.
