
News Topical, Digital Desk : The Canadian government has introduced a new version of Bill C-12, titled the Strengthening Canada's Immigration System Act. The legislation aims to tighten border controls, curb illegal activities, and make the immigration system more transparent.
The government says this will curb illicit fentanyl trafficking, money laundering, and cross-border crime. While this will not affect Indian permanent residents already living in Canada, conditions will be tougher for asylum seekers.
What is there in the new law?
Under the new bill, if someone arrived in Canada after June 14, 2020, and claims asylum more than a year later, their application will not be sent to the Immigration and Refugee Board of Canada. This rule applies to everyone, whether they are students, permanent visa holders, or anyone else, regardless of whether they left Canada or returned.
Additionally, those who enter Canada illegally from the US border and seek asylum after 14 days will also have their applications rejected. If someone enters illegally or without documents, it will be even more difficult to obtain asylum.
Who will not be eligible?
Those who have previously sought asylum or immigration in another safe country will no longer be eligible to apply in Canada. The new system will expedite asylum applications, but will also require more rigorous scrutiny. This will reduce wait times, but could increase rejections if insufficient evidence is available.
Under the new law, IRCC will be given greater powers. It can now cancel, suspend, or modify any immigration document if it finds incorrect information, inconsistencies, or evidence of fraud.
