New Delhi: The issue of extradition of ousted Bangladesh Prime Minister Sheikh Hasina has once again gained momentum. Chief Advisor to the interim government of Bangladesh, Mohammad Yunus, has met International Criminal Court (ICC) lawyer Karim AA Khan.
The talks between the two focused on the process of trial of the accused for crimes against humanity.
What is the treaty between India and Bangladesh?
The biggest question is can India send Sheikh Hasina back to Bangladesh? The possibility of this is very low. However, there is an extradition treaty between India and Bangladesh since 2013. According to the extradition treaty, both countries have to hand over each other's criminals.
In 2015, Bangladesh handed over Anup Chetia to India. Anup Chetia was the leader of Assam's separatist organization ULFA. He was imprisoned in Dhaka jail in 1997.
Can the treaty be broken?
There is a provision in the treaty that if a person has committed a crime for which the sentence is at least one year, he will be extradited.
It is noteworthy that Article 21(3) of this treaty between the two countries allows both countries to terminate this treaty. It is possible that India can break this treaty in the case of Sheikh Hasina's extradition.
194 cases registered against Sheikh Hasina
A total of 194 cases have been registered against Sheikh Hasina, her sister Sheikh Rehana and 69 others, including the murder of a weaver. 76-year-old Hasina had to leave Bangladesh and seek refuge in India after violent anti-reservation protests broke out in Dhaka's Kafrul area on August 5.
