Atul Subhash's wife Nikita Singhania has got a big shock from the Karnataka High Court. The High Court on Monday rejected the petition seeking quashing of the FIR registered against Nikita Singhania. The court issued notice to the respondents and directed them to file objections.

 

In December last year, IT employee Atul Subhash committed suicide after being fed up with the torture of his wife Nikita Singhania and her family. Before committing suicide, he had narrated the entire story of torture in a 24-page suicide note and a long video. According to Atul, his wife had demanded a sum of Rs 3 crore for divorce.

 

The bench issued a verbal order

A single bench headed by Justice SR Krishna Kumar passed the oral order. In the petition, Nikita Singhania had demanded the cancellation of the FIR. But the bench said that everything has been given in the FIR to register a case under abetment to suicide.

 

The bench asked- why don't you want to get the investigation done?

The bench asked Nikita, "Prima facie elements of crime are emerging in the complaint. Why don't you want to get the investigation done?" While Singhania's lawyer told the court that there is no element in the complaint to register an FIR for abetment to suicide.

 

What else did the lawyer argue?

The lawyer also said that the deceased Atul Subhash has not mentioned any act by his wife and family members which forced him to commit suicide. He further said that the petitioner has the right to seek legal remedies. He cannot be arrested just for filing a complaint against Atul Subhash.

 

These people got bail

On January 4, a Bengaluru court granted bail to wife Nikita Singhania, mother-in-law Nisha Singhania and Anurag Singhania in the Atul Subhash suicide case. Meanwhile, Atul Subhash's family is considering going to the High Court against the decision. After Atul Subhash committed suicide, the police registered a case against the accused under Section 108, 3 (5) of the Indian Penal Code (BNS) on December 9.
