Shri Krishna Janmbhoomi: The Muslim side has got immediate relief from the Allahabad High Court today in the ongoing land dispute cases between Shri Krishna Janmabhoomi and Shahi Idgah Mosque of Mathura. The Allahabad High Court has decided to hear the recall petition of the Shahi Idgah Mosque Committee before starting the trial of the one and a half dozen cases filed by the Hindu side. 

 

The High Court has summoned the reply from the temple party on the Muslim party's recall petition. The temple party will have to file its reply by September 23. During the hearing in the High Court today, Hindu party Ashutosh Pandey has filed an application demanding that the trial of the cases be conducted on a day-to-day basis. The High Court will hear the case only after disposing of the Muslim party's recall petition.

 

Muslim side has filed recall petition.


In fact, in January this year, Allahabad High Court had passed an order to hear all the eighteen petitions of Hindu side related to Shri Krishna Janmabhoomi and Shahi Idgah Mosque dispute of Mathura together. Shahi Idgah Mosque Committee had filed recall petition in High Court against this order. High Court had started hearing on maintainability of petitions without disposing of this recall petition and has also given its verdict. 

In today's hearing, when the proposal was given to decide the issues before the trial of the cases, the mosque committee appealed to the court to first dispose of the recall petition. Supreme Court advocate Tasneem Ahmadi argued on behalf of the Muslim side. The court has decided to dispose of the recall petition before starting the trial process and has sought a reply from the Hindu side in this regard.

 

Next hearing will be on 23 September


The case was heard by the single bench of Justice Mayank Kumar Jain. The court will hear the case again on 23 September at 2:00 pm. The recall petition has been filed in ward number 7, not the mosque committee. Advocate Mahendra Pratap Singh of ward number 13 gave his proposals of points of dispute to the court regarding the trial of the case. One of the parties, Ashutosh Pandey, demanded that the case be heard on day to day basis. Apart from this, advocate Hare Ram Tripathi has sought time from the court to file a separate reply. 

 

Let us tell you that many cases were filed by the Hindu side in the Mathura court, claiming that Mathura's Shahi Idgah Mosque was the birthplace of Lord Shri Krishna. The High Court had decided to hear the Mathura dispute directly on its own court on the lines of the Ayodhya dispute. The Muslim side had filed an objection regarding the maintainability of the cases. In its decision given on August 1, the Allahabad High Court had rejected the objections of the Muslim side and considered the petitions of the Hindu side worthy of hearing.
