News Topical, Digital Desk : The US Department of Homeland Security has announced an interim rule halting the automatic extension of Employment Authorization Documents (EADs) for migrant workers. The move will impact thousands of foreign workers, including Indians.
"Aliens who apply to renew their EAD on or after October 30, 2025, will no longer receive an automatic extension," the department said in a statement Wednesday. This means that EADs automatically extended before October 30 will not be affected.
There will be more strictness after the new rule
The Trump administration stated that the new rule will require increased scrutiny and screening to protect public safety and national security. This new measure replaces the Biden administration's rule that allowed immigrants to work in the United States for up to 540 days even after their work permits expired, but with certain conditions, such as:
- The renewal application must be filed on time.
- Their EAD category should be eligible for automatic extension.
- The category on their current EAD matches the "Eligibility Category" or "Class Requested" listed on the receipt notice.
USCIS gave this advice
"This rule contains certain exemptions, including extensions provided through a Federal Register notice for TPS-related employment documentation," the statement said. The US government says the backgrounds of migrant workers under this rule will be reviewed multiple times. USCIS recommends that immigrants file a renewal application up to 180 days before their EAD expires to ensure they have timely renewal.
