The High Court rejected the anticipatory bail plea of ​​a resident of Auraiya district, refusing to grant him any relief. The accused is accused of having sexual relations with a woman for nearly five years under the pretext of marriage. He argued that the accused had exploited the victim for a long time and had even attempted to intimidate her through private videos. The government argued that granting anticipatory bail to the accused despite such serious charges would be against both the law and social interest.

The court stated in its order that the record clearly demonstrates that the accused's intent was dishonest from the outset. He entered into a relationship with the victim solely to satisfy his personal desires and never had the genuine intention of marrying her. The court held that this conduct clearly constitutes deceit and fraud.

Citing the Supreme Court's decision, consent will be considered

Citing the Supreme Court's landmark decision, Deepak Gulati v. State of Haryana, the High Court held that if the promise of marriage is false from the outset and is solely intended to obtain the woman's consent, such consent cannot be legally valid. This act constitutes a serious crime.

Crimes against society, no scope for leniency

The court concluded by stating that the exploitation of women under the pretext of marriage is not merely an individual crime but a detriment to society as a whole. Showing leniency in such cases would only promote wrong practices. On this basis, the High Court rejected the accused's anticipatory bail plea.
