News Topical, Digital Desk : The Rajasthan High Court has directed that 3 percent additional marks be given to the transgender community for admission to government jobs and educational institutions.
The court called the government's decision to include transgender people in the Other Backward Classes (OBC) list a mere eyewash and said it was not providing them with any real benefits. The state government should develop an effective reservation policy similar to those in Karnataka and Tamil Nadu.
The Rajasthan High Court has directed to constitute a high level committee under the chairmanship of Additional Chief Secretary of Social Justice and Empowerment Department to formulate a new effective policy.
The committee must include prominent representatives from the transgender community and society. The court deemed the 2023 notification, which included transgender people only in the OBC category, unconstitutional.
The division bench of Justice Arun Monga and Justice Yogendra Kumar Purohit gave this decision while hearing the petition of eunuch Gangakumari, resident of Jalore.
The lawyers on behalf of the petitioner argued that the state does not provide separate horizontal reservation to transgenders, due to which transgenders born in Scheduled Caste and Scheduled Tribe families have to choose between their birth-based category or transgender, which is detrimental for them.
According to government records, the transgender community in the state has a population of 16,517. The state's total population exceeds 60 million, of which the OBC population is 32.4 million.
The transgender community constitutes 0.024 percent of the total population and 0.046 percent of the OBC population. The Rajasthan High Court held that separate horizontal reservations under the roster system would not be practical for such a small population, as their turn would come after a very long time.
