News Topical, Digital Desk : In a landmark verdict, the Supreme Court on Wednesday dismissed four appeals filed by former Police Commissioner and former Joint Director of the CBI Neeraj Kumar and his subordinate officer, former ACP of Delhi Police Vinod Pandey, challenging two June 2006 decisions of the Delhi High Court.
Delhi High Court gave this order
In its orders, Delhi High Court had ordered registration of 2 FIRs against these two police officers for tampering with documents during the investigation of a case against former IRS officer Ashok Kumar Agarwal and illegally detaining his younger brother Vijay Agarwal in violation of court orders and harassing him with the aim of forcing him to withdraw the perjury case filed earlier by Ashok Agarwal against Neeraj Kumar. The High Court had also ordered initiation of criminal contempt proceedings against these two officers.
The Supreme Court made this remark
The Supreme Court further said that it is a travesty of justice that the allegations disclosing cognizable offences in the year 2000 could not be investigated in the last 25 years against these two police officers who were on deputation to the CBI at the relevant time. The Supreme Court further said that the investigating officer will be of the level of ACP of Delhi Police, who will arrest them if required. This is the first time that two criminal cases registered against a senior police officer on deputation to the CBI have been investigated.
