News Topical, Digital Desk : The Supreme Court on Wednesday issued contempt notices to the chief secretaries of Delhi, Chhattisgarh, Jharkhand, Maharashtra, Telangana and Bengal for non-compliance of its orders regarding medical facilities and other allowances to retired high court judges.

 

Justice Abhay S Oka's bench is hearing the matter

A bench of Justice Abhay S Oka and Justice Ujjal Bhuiyan said that these states have not followed the instructions issued on February 18. The bench clarified- "Chhattisgarh, Jharkhand, Maharashtra, Telangana, Bengal and Delhi have not followed all the instructions issued by this court.

 

Contempt notice issued to chief secretaries

A notice should be issued to the Chief Secretaries of the above states, asking them to explain why action should not be taken against these states under contempt of court.

 

Personal presence of Chief Secretaries is not required

The next hearing of the case is scheduled for July 25. The apex court also said that personal presence of chief secretaries is not required provided a responsible IAS officer is present either in person or virtually.

 

The case relates to a contempt petition filed by retired judge VS Dave, who is the president of the Association of Retired Judges of the Supreme Court and High Courts. The petition has been pending since 2015 as several states have not implemented uniform medical facilities for judges after retirement.

 

Air Force school in Allahabad not a 'state' under Constitution: Supreme Court

The Supreme Court on Wednesday said that the Air Force School at Bamrauli in Allahabad is not state-controlled and the services of its contract employees cannot be regularised.

 

A three-judge bench headed by Justice Abhay S Oka, in a 2:1 majority verdict upheld the division bench of the Allahabad High Court that schools are not within the meaning of Article 12.

 

Other bodies subject to government control

Article 12 essentially outlines which institutions will be recognised for the purpose of guaranteeing these rights, including the central and state governments, local authorities and other bodies subject to government control.
