News Topical, Digital Desk : In Uttar Pradesh, police will no longer register cases in 31 cases, including dowry harassment and domestic violence. Uttar Pradesh Director General of Police (UP DGP) Rajiv Krishna has issued instructions to officers in all districts. Following this directive, police stations will receive complaints in these cases, and cases will only be registered after a court order.

According to UP DGP Rajiv Krishna, filing an FIR in cases where the law only provides for a complaint is utterly wrong. This order was issued following objections from the Lucknow bench of the Allahabad High Court. On February 25th, the Lucknow bench of the High Court issued strong comments on the matter in Anirudh Tiwari vs. the Uttar Pradesh government.

High Court raised objection?

The court had objected to the registration of an FIR under Section 82 of the Indian Penal Code (BNS), observing that Section 219 of the Indian Penal Code, 2023 provides that no court shall take cognizance of any offence punishable under Sections 81 to 84 of the Indian Penal Code, 2023, unless a complaint has been made by a person aggrieved by the offence.

Does the police register an FIR against the rules?

According to DGP Rajiv Krishna, police often register FIRs in violation of the rules, giving the accused an advantage in court. This also hampers the investigation process. Considering this a serious error, he has instructed all station heads and investigators to ensure that any case is legally regulated before registering an FIR.

Instructions for studying the provisions of the law

The DGP clarified that such cases include defamation, domestic violence, the Negotiable Instruments Act (check bouncing), the Mines and Minerals Act, the Consumer Protection Act, and cruelty to animals. Furthermore, 31 different laws, including dowry, only provide for filing a complaint in court. He directed station in-charges and investigators to carefully study the legal provisions and ensure action is taken based on this.
