The Supreme Court has refused to interfere in the FIR registered against Neha Singh Rathore for tweeting after the Pahalgam attack. The Supreme Court said that it is not inclined to interfere at this stage. The bench of Justice JK Maheshwari and Justice Vijay Bishnoi said that it is not inclined to intervene at this time. With this, the Supreme Court has dismissed Neha Singh Rathore's petition.

This case concerns a social media post related to the Pahalgam terrorist attack. Neha Singh Rathore is accused of using offensive language against the Prime Minister and the Home Minister in her post. Neha Singh Rathore had sought the quashing of the FIR filed against her for her social media post. However, the Supreme Court has clearly stated that the investigation will continue.

A case has been registered against Neha under these sections.

The UP police filed charges against Neha Singh Rathore under sections 196, 197, 152, and 353 of the Indian Penal Code (IPC), 2023, and section 69A of the Information Technology Act. Later, charges related to sedition were also added. Neha filed a petition in the Supreme Court, arguing that it was wrong to frame her on charges of "conspiracy against the country" based solely on a single social media post.

What did Neha's lawyer say?

Neha Singh Rathore's lawyer, Kapil Sibal, argued in the Supreme Court that she was willing to face trial, but could not be charged with sedition. However, the Supreme Court said that she could raise these issues during the trial or at the time of charge framing.
