The Supreme Court on Tuesday expressed displeasure over the Allahabad High Court order which said that the rape victim has invited trouble on her own. A bench led by Justice BR Gavai found the remark highly insensitive. In a controversial order, the Allahabad High Court while granting bail to a rape accused said that the complainant had "invited trouble on her own" by agreeing to go to the applicant's house after consuming alcohol. The news comes days after the apex court intervened to stay an "insensitive" order passed by another high court judge in an attempted rape case.

The order passed last month by Justice Sanjay Kumar Singh said the woman was an MA student and was therefore "capable of understanding the morality and significance of her act. The court had said, yes, bail can be granted... but what is this talk that she invited trouble herself etc? One should be careful while saying such things, especially on this side (judges). One thing here and there," Justice BR Gavai said. Justice Gavai listed the matter after four weeks.

Last week, a petition challenging the high court order by civil society network Just Rights for Children Alliance and the victim's mother came up for hearing before a bench of Justices BR Gavai and Augustine George Masih.
