
News Topical, Digital Desk : Indore's cartoonist Hemant Malviya, who is facing a case for posting an objectionable cartoon on the Prime Minister and RSS on Facebook, has approached the Supreme Court for relief. Hemant Malviya has filed a petition in the Supreme Court seeking anticipatory bail.
The Supreme Court has agreed to hear the petition on July 14. The Madhya Pradesh High Court had rejected Hemant Malviya's anticipatory bail plea on July 3. The High Court had said that this is an abuse of freedom of expression. After the rejection of the petition by the High Court, Malviya has now approached the Supreme Court seeking relief.
requested an early hearing
On Friday, advocate Vrinda Grover, appearing for Malviya, referred to the petition before a bench of Justice Sudhanshu Dhulia and Justice Joymalya Bagchi and requested an early hearing. Grover said that this case is related to a cartoon which Malviya had made in 2021 during the Corona epidemic. He said that the alleged crime carries a punishment of three years under the BNS.
He said that the High Court has condemned the cartoonist by dismissing the petition. After hearing Grover's arguments, the Supreme Court accepted his request and directed to put the case for hearing on July 14.
RSS worker had complained
In this case, RSS worker and local lawyer Vinay Joshi had filed a complaint against Hemant Malviya in Lasudia police station of Indore in May, stating that posting objectionable content on social media has hurt the religious sentiments of Hindus and spoils communal harmony.
The complaint mentioned several objectionable posts which included derogatory comments about Lord Shiva and cartoons, videos, photos, and objectionable comments about Prime Minister Narendra Modi and RSS workers, etc.
