News Topical, Digital Desk : A new legal twist has emerged in the much-discussed rape case involving a mentally retarded woman admitted to the Department of Psychiatry at the Uttar Pradesh University of Medical Sciences.
The Civil Judge Senior Division Court on Thursday expressed its inability to hear the petition filed by Saifai Police seeking permission for abortion of the victim and said that the case should be presented before the High Court.
Now, Inspector-in-Charge Bhupendra Rathi, who is investigating the case, and the university administration will jointly complete the further process and submit an application for permission in the Allahabad High Court.
The police's petition to the court relied on the victim's medical condition, her mental state, and the report of a medical board constituted by the university. Medical examinations revealed the victim was over 16 weeks pregnant. Experts' reports indicate that abortion is legally possible up to 20 weeks, but court permission is required in such cases.
The reports of three committees formed by the university administration have become crucial in this entire matter. The nine-member investigation committee, headed by Dean Professor Dr. Adesh Kumar, identified negligence on the part of the department head, Professor AK Mishra, along with 14 staff members posted in the ward, and the cleaning company involved in the work. Following this, the report was presented at the Executive Council meeting and the process for departmental action has been initiated.
At the same time, the nine-member medical board constituted under the supervision of Chief Medical Superintendent Professor Dr. SP Singh for the health examination of the victim, which was headed by the Head of the Gynaecology Department Professor Dr. Kalpana Singh, in its report has stated that the victim is about 16 weeks and five days pregnant.
It has also been mentioned that the mental condition of the victim is not such that she can take care of the child herself, in such a situation it may be appropriate to get an abortion done after the permission of the court.
It is noteworthy that an unidentified woman, approximately 38 years old, was admitted to the mental health department on June 14, 2025. On March 17, 2026, during a routine examination, she was confirmed to be pregnant, after which the entire matter came to light.
After this, a case was registered in Saifai police station by Professor Dr Arun Kumar Mishra, Head of the Department of Mental Illness, in which sanitation worker Ravindra Kumar Valmiki, resident of Lakhna, Bakewar police station, Etawah district, was made the accused.
The police arrested the accused and produced him in court, where he was sent to jail. Subsequently, DNA samples from the victim and the accused were sent for testing, and the victim's statement was recorded in court with the help of experts.
In this regard, University Registrar Deepak Verma stated that all necessary medical procedures, including a health examination of the victim, have been completed and the relevant report has been provided to the investigating officer. The university administration is cooperating with the investigation and legal process at every level.
Inspector-in-Charge Bhupendra Rathi stated that the lower court has expressed the need to present the case before the High Court. Now, as per the legal process, a petition will be submitted to the High Court seeking further permission.
