New Delhi: The Supreme Court on Tuesday banned bulldozer action against criminals and in other cases across the country. The court said that till the next order, there will be no arbitrary bulldozer action anywhere in the country. However, this is an interim order of the Supreme Court. The apex court will issue guidelines in this regard. All the states of the country will have to follow these instructions.

The Supreme Court will now hear the petition against the bulldozer action on October 1. The apex court also raised questions on the glorification of the bulldozer action. The court said this should stop.

Action will continue on illegal construction

During the hearing, the Supreme Court said that till the next hearing, action should be taken only with our permission. The apex court has clarified that this direction will not apply to illegal construction on roads, footpaths, railway lines.

The executive cannot become a judge

Senior advocate CU Singh said that vandalism is happening every day. Solicitor General Tushar Mehta told the court that notice was given in 2022 and action was taken after that. Meanwhile, crimes have also happened. Justice Gavai said that when notices were issued in 2022, then why the hurry in 2024? The state government should be informed.

Justice Vishwanathan said that let me make it clear that we will have instructions. These are being called guidelines. Demolition without the permission of the court should be banned till the next date. Justice J Gavai said that we have made it clear that we will not interfere in unauthorized construction, but the executive cannot be a judge.

The sky will not fall in 15 days

The Supreme Court passed this order using its special powers under Article 142 of the Constitution. But Solicitor General Tushar Mehta objected to the order. He said that the hands of statutory officials cannot be tied like this. On this, the bench said that if demolition is stopped for two weeks, the sky will not fall. Justice Gavai said, "Hold your hands. What will happen in 15 days?"
