News Topical, Digital Desk : Kumar Vishwas's wife and former RPSC member Manju Sharma has filed a petition in the High Court challenging the High Court's single bench decision on the Rajasthan Sub-Inspector Recruitment Examination 2021. A special appeal has been filed against the High Court's order and comments. The special appeal filed by Manju Sharma states that the High Court's comments against the petitioner are harsh and unfair.
It has been said on behalf of Manju Sharma that the petitioner was not made a party in this case nor was he given minimum and full opportunity of hearing, which is against the principles of natural justice.
'The court cannot make derogatory remarks without hearing'
Manju Sharma resigned from her post on August 28th following the court's orders in the Sub-Inspector Recruitment Exam 2021 paper leak case. She has filed a petition challenging the High Court's subsequent comments. She stated in the petition, "This is a violation of Articles 14 and 21 of the Indian Constitution. The court cannot make derogatory remarks against anyone without a hearing."
What did Manju Sharma request to the High Court?
Manju Sharma has requested the court expunge the comments made against her and reconsider the order cancelling the recruitment process. The High Court is expected to hear the case next week.
What did the single bench of the High Court comment on?
In its August 28 order, a single bench of the High Court made serious comments about the then-Chairman and members of the RPSC. Justice Sameer Jain wrote in his judgment that Shobha Raika, daughter of former member Ramu Ram Raika, had received good marks in the SI recruitment interview. To achieve this, Raika had met with then-RPSC Chairman Sanjay Shrotriya and other RPSC members, including Babu Lal Katara, Manju Sharma, Sangeeta Arya, and Jaswant Rathi.
The court also noted that Raika had recommended that they ensure her daughter passed the interview. The involvement of these members indicates systemic corruption within the RPSC, which threatens the credibility of the recruitment process at both the interview and written examination stages.
