New Delhi:  The Supreme Court has upheld Delhi Lieutenant Governor VK Saxena's decision to nominate 10 'aldermen' to the Municipal Corporation of Delhi (MCD). The Supreme Court said that the LG's decision to nominate 10 'aldermen' to the Municipal Corporation of Delhi does not require the aid and advice of the Council of Ministers. The Supreme Court said that the power of the LG to nominate members to the MCD is a statutory power and not an executive power.

Earlier, Aam Aadmi Party had opposed the decision of appointment of MCD councillors in Delhi without consulting the ministers of Arvind Kejriwal government. A petition was filed in the Supreme Court in this regard. On which the Supreme Court has given its decision today. 

It is noteworthy that on this decision of Delhi Lieutenant Governor Vinay Kumar Saxena, Chief Justice DY Chandrachud, Justice PS Narasimha, JB Pardiwala had reserved the order after hearing on May 17 last year. 

What did the Supreme Court say?

Let us tell you that the Supreme Court had said in this case last year that the power of nominating MCD councillors with the Lieutenant Governor means that he can destabilize the Municipal Corporation. MCD has 250 elected and 10 nominated members.

Powers of the Lieutenant Governor

Last year, when the councillors were nominated, the Lieutenant Governor's Office had said that under the powers conferred under the DMC Act, the Lieutenant Governor has the right to nominate 10 people to the Municipal Corporation. It was said that the Lieutenant Governor has full authority to appoint councillors under legal and constitutional provisions.

Delhi government made this claim

Chief Minister Kejriwal had claimed that the Delhi government itself nominates members in the MCD, but the LG nominated the members without consulting the government. Under the Constitution, the right to nominate lies with the government.
