News Topical, Digital Desk : The Rajasthan High Court has issued a significant ruling on live-in relationships. The court stated that even if a boy and a girl are not of marriageable age, they can still live in a live-in relationship if they wish.

An 18-year-old woman and a 19-year-old man from Kota filed a petition in the Rajasthan High Court. Justice Anoop Dhand delivered this ruling while hearing the petition.

The lawyer argued

The government lawyer in the Rajasthan High Court stated that the boy and girl are not yet of marriageable age. The boy is under 21 years of age and the girl is under 18 years of age. Therefore, they cannot be allowed to live in a live-in relationship.

The court gave its verdict

The court rejected the government lawyer's argument, saying everyone has the right to life and personal liberty under Article 21. Therefore, any threat to the petitioner would be considered a constitutional violation.

According to the court,

The petitioners cannot be denied their fundamental rights merely on the ground that they are not eligible for marriage. Live-in relationships are neither illegal nor criminal under Indian law.

What is the whole matter?

The couple had been living in a mutually agreed-upon live-in relationship. According to the petitioner, the couple has been in a live-in relationship since October 27, 2025. However, the girl's family is opposing this and has threatened to kill the couple. In response, the couple has requested police protection.

The couple claims that despite submitting a written application to the Kota police, no action was taken. The court has ordered the Bhilwara and Jodhpur police to provide security for the couple.
