The Supreme Court on Monday heard the case of bulldozer action being taken against criminals in many states including Uttar Pradesh. During the hearing, the Supreme Court asked how can someone's house be demolished just because he is an accused. The petition alleges that houses are being demolished without notice. 

 

Illegal construction can be demolished only by giving notice 

Solicitor General Tushar Mehta said in the apex court that according to municipal rules, illegal construction can be demolished only after giving notice. After this, the Supreme Court said that we will make guidelines in this regard. All states should follow it. The Supreme Court will now hear the bulldozer action going on across the country on September 17.

 

What did Justice Gavai say?

Justice Gavai said that the UP government's affidavit states that immovable property can be demolished only according to the procedure established by law. UP's Special Secretary Home has also filed an affidavit. We propose to set some guidelines at the all-India level, so that the concerns raised can be addressed. We appreciate the step taken by the UP government.

We feel it is appropriate that counsel for the parties give suggestions so that the Court can lay down guidelines which would be applicable at the all India level.
