Law Correspondent, Prayagraj. Allahabad High Court has said that the anti-religious conversion law is in its initial stage, it has been made to stop the evil practice prevalent in the society. If the court interferes in the prosecution proceedings then this law will fail to achieve its objective. With this comment, the court has refused to give relief to Ruksar, a woman accused of pressuring to change religion. This order has been given by the division bench of Justice JJ Munir and Justice Arun Kumar Singh Deswal while dismissing Ruksar's petition.
The victim has lodged an FIR in the city police station of Chitrakoot under Sections 376 and 506 of the Indian Penal Code and Sections 3 and 5(1) of the anti-religious conversion law. She alleged that when she was studying in Class 10, Abdul Rehman used to follow her everywhere. One day he took her to his house and raped her. After that, he kept raping her several times.
Abdul's younger brother also raped her
After Abdul got married, his younger brother Irfan also raped her and the petitioner Ruksar was pressured to convert to Islam and marry her husband's brother Irfan. The victim alleges that on March 30, 2024, she was gang-raped and made to wear a burqa and sit in a train for Karvi. There, Rehman took her home and raped her and threatened to kill the entire family if she revealed the secret.
The court refused to give relief to the woman
The advocate of the petitioner said that she is a woman and the co-accused are accused of rape, so she should be given relief. The court refused to give relief saying that the petitioner is accused of forcing her to convert to Islam and marry her husband's brother. The court said, in such a situation, interference cannot be done.
