A lawyer had to pay a heavy price for repeatedly writing consensual relationship in the bail petition. The Supreme Court reprimanded the lawyer and said that you do not know the ABCs of law. In the bail petition of the accused of raping a minor girl, the lawyer had repeatedly mentioned consensual relationship.
This angered the Supreme Court bench. The bench wanted to tell the lawyer that if the victim is a minor then consent does not matter. However, later the lawyer also apologized to the bench. After this, the apex court issued notice to the police and others on the bail plea.
The bench asked- what is the age of the girl?
A bench of Justice N Kotishwar and Justice Suryakant heard the bail plea on Thursday. Justice Suryakant said that after reading the petition, we became mentally ill. You have written 'consensual relationship' at least 20 times in the SLP (special leave petition). Justice Suryakant asked what is the age of the girl? You yourself have mentioned her as a minor in the petition.
I don't know the ABCs of law
Justice Suryakant told the lawyer that you have written 'consensual relationship' in every paragraph. What do you mean by consensual relationship? You do not know the ABCs of law. Why are you filing SLP?
How do these people qualify for AOR
The Supreme Court bench asked whether you are an AOR (Advocate-on-Record)? The bench further said that how are these people eligible (for AOR)? You do not know the basic law. You have written 'consensual relationship' 20 times. Tomorrow you will say that you had consensual relations even with an 8-month-old child.
