Tahir Hussain Gets Parole: Delhi High Court has given a big relief to Mustafabad assembly seat AIMIM candidate Tahir Hussain. The High Court has given custody parole to Tahir Hussain to file nomination from Mustafabad seat. Presenting the application for interim bail on behalf of Tahir Hussain, lawyer Rebecca John had said that filing nomination in assembly elections is a complicated process, which has to be completed by January 17. On this, the court had reserved the decision after hearing on Tuesday (January 14).
Parole conditions
The Delhi High Court has granted custody parole to AIMIM leader Tahir Hussain to file his nomination. He is currently in judicial custody in cases related to the Delhi riots. While granting custody parole to Tahir Hussain, the Delhi High Court has laid down some conditions, which are as follows-
1. Tahir Hussain will not talk to anyone except the concerned officials during the nomination process.
2. Tahir Hussain will not use any mobile-landline or internet.
3. Tahir Hussain will not talk to the media.
4. Family members of the accused (Tahir Hussain) can be present, but they will not be allowed to take photographs of the nomination filing or post them on social media.
'Contesting elections is not a fundamental right'- Delhi Police
During the hearing, the High Court had asked whether Tahir Hussain has been given a ticket to contest the assembly elections? In response to this, Tahir Hussain's lawyer said that he has got an AIMIM ticket from Delhi's Mustafabad assembly constituency.
On this, ASG Chetan Sharma, the lawyer appearing on behalf of Delhi Police, said that contesting elections is not a fundamental right. If you are accused of a serious crime, you can file nomination but there will also be a danger of influencing witnesses. ASG gave the example of Baramulla MP Engineer Rashid and independent MP Amritpal Singh from Khadoor Sahib. He said that candidates have won elections even after filing nomination from jail.
During the hearing, the High Court asked where do the witnesses of the Delhi riots 2020 case live? On this, the ASG said that the witnesses live in the same locality where Tahir Hussain's house is. Tahir Hussain's lawyer also gave the example
of Engineer Rashid and said that Rashid was granted interim bail for three months to contest the elections and campaign for it.
Demand for custody parole
According to the lawyer, Tahir Hussain said, "My crime has not been proven yet and the election campaign will end on February 4. I will surrender immediately after that. If I am given custody parole, we will accept it but we should be allowed to campaign." High Court judge Neena Bansal had reserved the order after hearing the arguments of both the parties.
