Bahraich Violence: The Lucknow Bench of Allahabad High Court on Wednesday once again granted 5 days' time in the case of notices of bulldozer action on 23 houses pasted by the PWD department after the violence in Mahsi of Maharajganj in Bahraich. Now the next hearing in this case will be on November 11. The government has filed its reply in this case, after which the other party has been given time to file its reply. 

Talking to ABP News about the hearing of this case, the advocate said that the court has made several comments verbally. The court verbally said that when you propose to demolish a structure, it cannot be done selectively. The state has to follow the law and ensure that the law is followed at every step.

Answers sought on these points
Along with this, the court has verbally commented on this matter and has sought answers from the state government on four points. The court has asked whether any survey was done there before issuing the notice or not? Are the people to whom the notice has been issued the owners of the built-up complexes or not? Is the person who issued the notice the competent authority for this or not? Is the entire construction or some part of the construction for which the demolition notice has been issued illegal? Along with this, the court has also directed the petitioner to issue an objection against the notice.

 

This case is being heard by a division bench of Justice AR Masoodi and Justice Subhash Vidyarthi. In this case, a PIL was filed by the Association for Protection of Civil Rights, in which a demand was made to cancel the demolition notice issued against the alleged encroachers of Bahraich.
