News Topical, Digital Desk : The Supreme Court on Tuesday sought response from the Centre and other parties on a plea challenging the validity of a rule relating to the custody of animals.

A bench of Justices Vikram Nath and Sandeep Mehta agreed to hear the petition and issued notice to the Centre and other parties.

The petition seeks to declare Rule 3 of the Prevention of Cruelty to Animals Rules, 2017 as contrary to the Prevention of Cruelty to Animals Act, 1960, particularly Section 29, and consequently, to be unconstitutional.

Section 29 of the 1960 Act deals with the power of the court to deprive a person found guilty of the ownership of animals.

The petition also seeks to declare the pre-conviction seizure, transfer or permanent deprivation of ownership of livestock authorized under Rule 3 unconstitutional as it violates Articles 14 and 300A of the Constitution, among others. Article 300A provides for the prohibition of deprivation of property without authority of law.
