
News Topical, Digital Desk : The Supreme Court has given a big decision in the case of rape of an 11-year-old girl in Ajmer, Rajasthan. The court declared the accused person juvenile in this case after about 37 years. The apex court upheld his conviction given by the lower courts, but directed him to appear before the Juvenile Justice Board (JJB).
The accused is now around 53 years old. In February 1993, the Additional Sessions Judge of Kishangarh, Ajmer convicted and sentenced him for raping and wrongfully confining the girl. In July last year, the Rajasthan High Court also upheld this verdict.
What did the accused's lawyers say in the Supreme Court?
According to the Indian Express report, the accused's lawyers claimed before a bench of Supreme Court Chief Justice B.R. Gavai and Justice Augustine George Masih that he was a juvenile at the time of the incident in November 1988. They said that his date of birth is September 14, 1972 and hence his age on the day of the incident would be 16 years, 2 months and 3 days. Since he was a juvenile, the current proceedings, especially the sentence, cannot be sustained.

The lawyers also urged that an inquiry be conducted to determine his age so that he can avail the benefits of the Juvenile Justice (Care and Protection of Children) Act, 2000 and the Juvenile Justice (Care and Protection of Children) Rules, 2007." The Supreme Court gave this verdict after the school admission and other documents were confirmed.
