News Topical, Digital Desk : A husband demanded a DNA test of his own children after discovering that his wife was having an extramarital affair. The Andhra Pradesh High Court, in its ruling, refused to allow the DNA test.
While dismissing the plea of a 59-year-old man, the High Court also upheld the trial court's order refusing permission for DNA fingerprinting of the children during the divorce case.
DNA test of children cannot be done
Justice Taraladha Rajasekhar Rao said, 'Even if it is assumed that the wife has an illicit relationship with another man, the husband cannot demand DNA test of the children.'
The court clarified that when the children are neither demanding maintenance from the father nor from the other man with whom the woman is having an affair, they cannot be dragged into this dispute.
