New Delhi: The lawyer of the accused called the death of three students due to drowning in the basement of Rao IAS Study Circle, a coaching centre located in Old Rajendra Nagar, an act of God. The lawyer argued that if the Municipal Corporation had performed its duties, the incident could have been avoided, but they failed miserably in doing so.

The basement was not a library - the lawyer argued

Principal District and Sessions Judge Anju Bajaj Chandna of Rouse Avenue Court, after hearing the arguments of the counsel appearing for the four accused, asked the counsel to complete his arguments on August 12. The accused include Parvinder Singh, Tajinder Singh, Harvinder Singh and Sarabjit Singh. The counsel appearing for the accused argued that the basement was not a library but a waiting area for students before classes.

The lawyer argued that the lease deed did not talk about the library but it did state that it was to be used for coaching purposes. The advocate claimed that the premises were inspected by the fire department a few days before the incident. He claimed that the report given by the fire department after the inspection stated that the basement was being used for storage purposes and the building was safe and suitable for running an educational centre.

The lawyer also argued that to apply the section of culpable homicide, there should be knowledge as well as the intention to commit the crime. The lawyer argued that did his clients give the property thinking that they would build a basement and one day when it would rain, they would kill someone. The lawyer told the judge that the four accused did not run away from arrest, but after coming to know about the incident, they themselves went to the police station.

During the hearing, the CBI counsel filed his reply on the bail plea of ​​the four accused. Earlier, the Tis Hazari court had disposed of the bail plea of ​​the four accused considering that the Delhi High Court has handed over the case to the CBI.
