News Topical, Digital Desk : RJD supremo Lalu Prasad Yadav, who is embroiled in the land for job scam, has demanded the cancellation of the FIR lodged by the CBI in the Delhi High Court. In the petition filed in the Delhi High Court, he says that the CBI registered this case without the necessary sanction, which is legally illegal.

Senior advocate Kapil Sibal, appearing for former Railway Minister Lalu Yadav in the Delhi High Court, argued that the investigating agency CBI registered the FIR on May 18, 2022, while Lalu Yadav was performing his official duties as Railway Minister at that time.

Lawyer Kapil Sibal said that under the Prevention of Corruption Act, mandatory sanction was necessary to start investigation in such a situation. As soon as an FIR is registered, the entire action becomes illegal. We are only demanding cancellation of the regular case. Filing the FIR itself was wrong. Lalu said that the FIR in this case has been registered after 14 years.

He said that in the earlier investigation, CBI had filed a closure report. Hiding the old case and starting a new investigation is a misuse of the process of law. This is clearly a case of political revenge and retaliation. Lalu Yadav is facing an illegal and biased investigation, which is a violation of fundamental rights.

Important comment of Delhi High Court 

In the Delhi High Court, the CBI accused Lalu Prasad Yadav of deliberately not completing the arguments on the charges in the trial court so that the case cannot proceed further. The CBI said that his arguments are left incomplete so that the case remains pending. Lalu Yadav is trying to prolong the case.

While hearing the case in the High Court, Ravindra Dudeja clearly said that even if the lack of sanction is accepted, it applies only to the crimes related to the PC Act and not to the sections of the IPC.

what is the whole matter 

This case is related to the alleged scam in Group-D posts in West Central Railway, Jabalpur during Lalu Yadav's tenure as Railway Minister between 2004 and 2009. In this case, it is alleged that in lieu of jobs, pieces of land were gifted and transferred to the names of Lalu Yadav's family or close associates.

The CBI had registered an FIR on May 18, 2022, naming Lalu Yadav, his wife, two daughters, some unidentified officials and private persons as accused.
