The Supreme Court on Monday said that several petitions related to the release of Surinder Koli in the Nithari case will be heard on March 25. Koli's lawyer told the bench of Justice BR Gavai and Justice Augustine George Masih that the evidence against his client is the confession, which was recorded by the police several days after he was taken into custody.
While directing to call for the trial court records of other cases related to this, the bench said that its copy should also be made available to the lawyers coming for this case.
The Supreme Court had agreed to hear in 2024 the separate petitions filed by the CBI and the Uttar Pradesh government challenging the Allahabad High Court's October 16, 2023 decision to release Koli.
sentenced to death penalty
The bench has sought Koli's response on the petition and attached it with other pending petitions. In May 2024, the Supreme Court had agreed to hear the petition of the father of a victim challenging the High Court's release order.
Koli was awarded death penalty by a trial court on 28 September 2010. It is noteworthy that Moninder Singh Pandher and his servant Koli were accused of raping and murdering children in Nithari, Noida.
