News Topical, Digital Desk : More than 1 million cases are pending in the country's district courts. Of these, 800,000 are more than six months old. The Supreme Court, noting the massive pendency of execution petitions, said, "This situation is very frightening and depressing."
However, the Supreme Court praised the efforts made by the district judiciary to implement its order, as more than 4.3 lakh execution petitions were decided in the last six months and about 7.7 lakh cases were disposed of in the last one year after its directions in March 2025.
The case remains pending even after the verdict.
The Supreme Court has asked all high courts to implement a system to expedite the disposal of these pending cases. Especially in property disputes, simply delivering a judgment is not enough. Often, the winning party has to go back to court and file an execution petition to enforce the order.
The next hearing will be on October 7, 2026
Meanwhile, a bench of Justices J.B. Pardiwala and Pankaj Mithal directed that execution petitions be disposed of within six months. Furthermore, after examining the pendency data, the bench noted that the High Courts had been asked to establish a system and provide guidance to their district courts for the speedy disposal of execution petitions, but the High Courts had not yet provided information on the steps taken. It then directed them to file their responses.
Additionally, the Supreme Court bench set the next hearing date for October 7, 2026. The court also directed the Registry to send a copy of the order to all High Courts. The Supreme Court initiated this initiative to streamline the hearing of execution petitions after it encountered a case in which both the High Court and the Supreme Court had received favorable judgments in a property dispute in 2006. However, two decades later, the execution petition remained pending in the lower court, depriving the petitioners of complete justice.
