The HC granted interim stay on the Sambhal court's order to register an FIR against Anuj Chaudhary and other police officers. Along with Anuj Chaudhary, the then-police station officer, Anuj Tomar, also received relief.
This petition was filed by Anuj Chaudhary and the Uttar Pradesh government, seeking a stay on the Sambhal court's order to register an FIR. The case was heard in the High Court on Tuesday by a single bench of Justice Samit Gopal. After hearing both parties, the court delivered its decision.
Allahabad High Court gives relief to Anuj Chaudhary
The Allahabad High Court has stayed the Sambhal court's order to register an FIR against ASP Anuj Chaudhary and other police officers. The court has ordered complainant Yamin to present his side and file a response to both petitions. The matter will be heard again in five weeks.
It should be noted that on January 9th, Sambhal CJM Vibhanshu Sudhir ordered the registration of a case under Section 156 (3) against 20 police officers, including police officer Anuj Chaudhary. The petition was filed by Yamin, the father of a young man injured in the Sambhal violence, alleging that his son had gone from home to work at a shop where the police shot him with the intent to kill him.
Even after this court order, no FIR was filed against Anuj Chaudhary. Anuj Chaudhary and the UP government then challenged the Sambhal court's order in the Allahabad High Court. Following this, the High Court today placed an interim stay on the lower court's order.
