News Topical, Digital Desk : A division bench of the Allahabad High Court has made an important observation regarding live-in relationships. The bench, comprising Justices JJ Munir and Tarun Saxena, stated that the court's role is to deliver judgments based on the law, not on social or family morality. If an act is not a crime under the law, the court cannot declare it wrong simply because of societal perception.

It is not a crime for a married man to live in a live-in relationship.

The court stated clearly that a married man living in a live-in relationship with an adult woman with her consent is not a criminal act in itself. Unless there is a violation of any law, the court will not consider such a relationship a crime.

This case involves a live-in couple who were receiving constant threats from the woman's family. In an application to the Shahjahanpur Superintendent of Police, the woman stated that she was an adult and living with her partner of her own free will. She also stated that her parents and other relatives were displeased with the relationship and were threatening to kill her.

Told the threat of honor killing

In her application, the woman also expressed fear that she and her partner were at risk of honor killing. Despite this, the High Court expressed displeasure over the police's inaction.

The court stated that if two adults wish to live together, it is the duty of the police to protect them. In such cases, it is the personal responsibility of the Superintendent of Police to ensure the safety of the couple's life and property.

A kidnapping case was filed based on a complaint from the woman's family. The High Court granted significant relief to the couple in this case as well. The court ordered that the petitioners will not be arrested until the next hearing.

Prevented contact and harm to family

The High Court directed the woman's family not to harass the couple in any way, not to contact them, or attempt to enter their home. They also warned of strict action if they threatened or harmed them.

The court clarified that the Shahjahanpur Superintendent of Police would be personally responsible for the couple's safety. If there was any lapse in security, accountability would be fixed.
