UP 69,000 Vacancy: The Supreme Court on Monday stayed the Allahabad High Court order, which asked the Uttar Pradesh government to prepare a new selection list of 69,000 assistant teachers in the state. The Supreme Court also stayed the High Court's order to cancel the selection lists of teachers released in June 2020 and January 2022, which included 6,800 candidates. Staying the High Court's decision, a bench of Chief Justice of India DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra also issued notices to the state government and others, including the secretary of the UP Basic Education Board, on the petition filed by Ravi Kumar Saxena and 51 others.

 

The Supreme Court said that it will hold the final hearing in this case. Also, the court asked the lawyers of the concerned parties to file a brief written 'note' of maximum seven pages. The bench said that it will fix the hearing on the petition in the week starting from September 23. Additional Solicitor General Aishwarya Bhati appeared in the apex court on behalf of the UP government.

 

What did the High Court order?


In August, the High Court had directed the state government to prepare a new selection list for the appointment of 69,000 assistant teachers in the state. A division bench of the High Court had issued this order while disposing of 90 special appeals filed by Mahendra Pal and others challenging the order of a single judge bench on March 13 last year. The bench had directed that while preparing the new selection list, any harmful effect on the currently working assistant teachers should be minimized so that they can complete the ongoing academic session. The bench had said that the purpose of this direction is to prevent disruption in the studies of the students. 

 

What will be the next step of the Yogi government?


Now the question arises that what will be the next step of the Yogi government after the Supreme Court ordered to suspend the High Court's order for the time being and sought a response from both the parties? According to legal expert Dr. Shashank, from a legal point of view, the next step of the government can be to make its position more clear in the Supreme Court by studying the High Court's decision in depth. The government can argue that making a new merit list can put the jobs of thousands of teachers who are already working at risk.

 

According to legal experts, along with this, the government can resolve issues related to reservation and present alternative solutions for the affected candidates of the new list so that legal hurdles can be overcome.
