Allahabad High Court: Allahabad High Court has rejected the bail plea of the accused of attempting to rape a four-year-old innocent girl. While rejecting the bail plea, the High Court has also made a harsh comment. The High Court has said that in a country where girls are worshipped, a heinous crime like rape of small girls is being committed. Expressing concern, the court said that such incidents are increasing continuously. The court said that this is a serious crime not only against the victim but also against the society.
According to the court, such a crime is a violation of the fundamental right to life under Article 21. If the right decision is not taken in such cases, people will lose faith in the justice system. The court refused to grant bail to the petitioner and directed to complete the trial in one year. The court said that an attempt was made to rape a girl who did not know the meaning of crime.
The court has rejected the bail plea of accused Ahsan of Katghar police station area of Moradabad. On 21st April this year at 3 o'clock in the day, the girl had gone to see a show happening outside the house. People told that the petitioner has taken her with him. The family started looking for the girl. When a sound was heard near the railway gate crossing, the petitioner ran away after seeing the family members coming. The girl was unconscious, her clothes were removed, there were many injuries on the body. An attempt was made to rape the innocent girl.
The petitioner alleged that he was being falsely implicated
. The petitioner said that he was innocent and had been falsely implicated. The FIR for the incident of April 21 was lodged six days later on April 27, but the reason for the delay was not given. The petitioner has been in jail since May 31. The petitioner had complained against the driver of the complainant, Waseem. He did a wrong thing and ran away and entered my house. A false FIR has been lodged against him.
The petitioner also said that there is a contradiction in both the statements of the victim, which is contrary to the medical report. No internal or external injury has been found in the medical report, whereas the FIR mentions injuries on the body. The petitioner has revealed the history of four criminal cases registered against him. The public prosecutor also opposed the bail and said that this crime is heinous. The accused does not deserve to be released on bail. The court rejected the bail application after hearing both the parties. The case was heard in a single bench of Justice Shekhar Kumar Yadav.
