To reduce road accidents and enforce stricter enforcement, the central government has made significant changes to the Motor Vehicles Act. Under the new rules, repeated minor mistakes can result in the suspension of a driver's license.
The Union Ministry of Road Transport and Highways has clarified that if a driver violates traffic rules five or more times in a year, their driving license can be suspended for three months. This rule came into effect on January 1. Its purpose is to curb drivers who repeatedly break rules but do not take them seriously.
Will old challans also be added ?
Previously, license cancellation or suspension was limited to serious offenses like vehicle theft, overspeeding, overloading, or assaulting passengers. Now, common offenses like not wearing a helmet, not wearing a seatbelt, and jumping a red light are also included if they are repeated.
The government stated that old invoices will not be counted. According to the ministry, each year will be counted separately. This means that invoices or violations from the previous year will not be counted towards the new year's five-infraction record. Records will be considered new starting January 1st each year.
Will I get a chance before my license is suspended ?
The government stated that under the principles of natural justice, any driver will be given a full opportunity to present their case before their license is suspended or revoked. Authorities will not take direct action. The Central Motor Vehicles Rules, 2026, have also tightened the rules regarding toll arrears.
Has there been any tightening in toll rules ?
- If there is toll due, NOC will not be given to sell the vehicle or take it to another state .
- Fitness certificate will not be renewed.
- Commercial vehicles will not get national permit.
Why is the government being strict ?
According to transportation experts, the government is preparing to implement a barrier-free toll system (free-flow tolling). This requires digital toll collection to ensure the government doesn't lose revenue and the system runs smoothly.
