Shri Krishna Janmabhoomi Case: A very important hearing is to be held today in the Allahabad High Court in the ongoing land dispute case between Shri Krishna Janmabhoomi of Mathura and Shahi Idgah Mosque. Today's hearing will be held in the single bench of Justice Mayank Kumar Jain from around 3 pm. Today, mainly the recall petition filed by the Muslim side is to be heard. The Shahi Idgah Mosque Committee has challenged the decision to hear together one and a half dozen petitions filed by the Hindu side in the High Court.
In today's hearing on 23rd (September), the Hindu side has to file its reply on the recall petition of Shahi Idgah Committee. Along with this, today there can also be a hearing on the demand to conduct the trial of the temple mosque dispute of Mathura on a day to day basis. In the last hearing held on 4th September, the Muslim side got immediate relief from the Allahabad High Court. The Allahabad High Court had decided to hear the recall petition of Shahi Idgah Mosque Committee before starting the trial of one and a half dozen cases filed by the Hindu side and had summoned the reply from the temple side.
The mosque committee had filed a recall petition.
The High Court had said that it will hear the Mathura temple mosque dispute only after disposing of the Muslim side's recall petition. It is worth mentioning that in January this year, the Allahabad High Court had passed an order to hear all the eighteen petitions of the Hindu side related to the Mathura Shri Krishna Janmabhoomi and Shahi Idgah Mosque dispute together. The Shahi Idgah Mosque Committee had filed a recall petition in the High Court against this order.
The High Court, where Tasneem Ahmadi is arguing on behalf of the Muslim side,
had started hearing on the maintainability of the petitions without disposing of this recall petition and had also given its verdict. In the hearing to be held today, when the proposal was given to decide the issues before the trial of the cases, the mosque committee appealed to the court to first dispose of the recall petition. Supreme Court advocate Tasneem Ahmadi is arguing on behalf of the Muslim side.
An affidavit can also be filed in the hearing.
The court has decided to dispose of the recall petition before starting the trial process. The Hindu side was asked for a reply in this regard. The case is being heard today in the single bench of Justice Mayank Kumar Jain. The mosque committee has filed a recall petition in case number seven. In the last hearing, Hindu party Ashutosh Pandey had demanded that the case be heard on a day-to-day basis. Apart from this, advocate Hare Ram Tripathi had sought time from the court to file a separate affidavit. His affidavit can also be filed in today's hearing.
The court had rejected the objections of the Muslim side.
Let us tell you that many cases were filed by the Hindu side in the Mathura court, calling the Shahi Idgah Mosque of Mathura as the birthplace of Lord Shri Krishna. The High Court had decided to hear the Mathura dispute directly on its own court, on the lines of the Ayodhya dispute. The Muslim side had filed objections regarding the maintainability of the cases. In the decision given on August 1, the Allahabad High Court rejected the objections of the Muslim side. The petitions of the Hindu side were considered worthy of hearing.
