While hearing the case in the Delhi High Court, Justice Ajay Digpal remarked that trafficking of newborn babies is a direct attack on the rights and dignity of children and cannot be considered a normal crime under any circumstances. The court said that such cases shake the conscience of the society and pose a serious challenge to law and order.
Police's serious allegations against interstate gang
During the Delhi High Court hearing, the lawyer representing the Delhi Police stated that the racket spans Delhi, Rajasthan, and Gujarat. Several accused are still absconding, and some children remain untraced. The court acknowledged that the Sessions Court granted bail based solely on the filing of a charge sheet, without adequately considering crucial aspects such as the gravity of the crime, the role of the accused, and the possibility of evidence tampering. According to the police, Poonam is the main operator of the racket, handling the procurement of newborn babies, negotiating commissions, and delivering them to buyers. Bimla was responsible for the receipt and further distribution of the trafficked children. Both women are alleged to have been involved in similar cases previously.
There is a danger of witnesses being influenced, the High Court issued strict instructions
The High Court stated that the investigation is not yet fully concluded, and some of the accused and children remain untraced. Therefore, releasing the main accused could hamper the investigation. The court also expressed concern that the possibility of them influencing witnesses or tampering with evidence after their release cannot be ruled out. Considering these reasons, the High Court revoked the bail of both women and directed them to surrender before the trial court within seven days.
