News Topical,Digital Desk : Delhi High Court On Corruption Case: The Delhi High Court made a serious comment on the alleged bribery conspiracy between the officials of CBI, ED and other government departments and said that such allegations shake the foundation of the country's investigation system. Justice Neena Bansal Krishna said that the facts revealed in the case point to large-scale corruption and a deep conspiracy among the officials, which requires police custody of the accused to expose.
The Delhi High Court granted two-day CBI custody to three government officials, saying that the investigation is still in its initial stages and in-depth interrogation is necessary to unravel the larger conspiracy. The court also clarified that the purpose of custody is not to force confessions from the accused, but to reach the root of corruption.
CBI gave important argument in the case
The CBI had argued in the High Court that the accused officers had demanded a bribe of Rs 35 lakh from the complainant to help him in his cases. Apart from this, another officer had demanded Rs 50 thousand in exchange for influencing the Enforcement Directorate officials. According to the CBI, a trap was laid and the accused was caught red-handed while taking a bribe of Rs 3.5 lakh. Fake identity cards of various departments were also recovered from his car. The CBI alleged that the case is not limited to the bribery of any one officer, but is part of a larger conspiracy spread across various departments, which is extremely important to expose.
The argument of CBI was opposed by the accused
The accused argued in the Delhi High Court that the CBI wants custody only to force a confession, which is legally wrong. But the court upheld the arguments of the CBI and said that in such cases, custodial interrogation of the accused is necessary during the preliminary investigation, considering the gravity of the crime. The High Court, citing the decision of 'Prakash Gupta vs State of Delhi', said that custody cannot be denied in serious crimes. Currently, with this decision of the Delhi High Court, the court ordered to send all the three accused to CBI custody for two days.
