A court here on Wednesday refused to send Bangladeshi national Mohammad Shariful Islam, arrested for allegedly attacking Bollywood actor Saif Ali Khan with a knife, to police custody and sent him to judicial custody.

 

Saif's accused in judicial custody

The court found that there was no new ground to extend his police custody. After considering the application by the police seeking further custody, the Bandra magistrate's court said that no new ground was made out for it. Judicial Magistrate (First Class) Komal Singh Rajput said, “Further police custody is not justified at least at this stage.”

After the end of police custody, Mohammad Shariful Islam was produced before the Bandra Magistrate's Court. Citing the provisions of the Indian Justice Code, the court told the investigating officer that if there is any new development, the police can again seek the custody of the accused for the remaining period within the stipulated time.

 

According to the new criminal laws, the police can seek custody of a person for up to 15 days. This can be consecutive or at intervals during a period of 40 or 60 days from arrest, depending on the severity of the crime. On the night of January 16, Saif Ali Khan was attacked at his house in Satguru Sharan Society in Bandra, Mumbai.
